The evolutionary path of development of legal regulation of property relations of spouses

The relevance of this study is explained by the importance of the institution of marriage for human society. A special subject of regulation of family legislation is property and related non-property relations between family members. The conclusion of marriage creates a kinship relationship between people who are strangers to each other up to this point and determines their further property relations. The author of this study emphasizes that historically marital and property relations are closely related to each other. Using the method of historical analysis, the author concludes that since the moment of marriage, not only the personal, but also the property status of the spouses has changed. Conducting a comparative analysis, the author compares family property in different cultures and civilizations. The article examines the evolution of the development of the right of common property of spouses, the content of the right of common joint and shared ownership. The works of recognized scientists in the field of civil law are used as a scientific base. The author of this study concludes that the relationship of spouses regarding common property has been developing over a long historical period and has undergone significant changes, reaching the present day. At the moment, the development of this legal institution seems promising and may be relevant for further legal research.
